SESSION ONE

Lessons to be learned from LawCover files
Janice Purvis

Reviews the causes and areas of claims against solicitors over the past three years and provides tips on how to avoid becoming a LawCover statistic.

Janice is the Risk Services Manager at LawCover and has been a claims solicitor since 2000.

SESSION TWO 

Session 2: Conflicts of Interest – Ignore them at your peril
Kerry Hogan-Ross and Robert Crittenden

Examines some of the main areas of conflict of interest for solicitors (including acting for more than one party, acting against a current or former client, acting where a solicitor’s personal interests are involved, acting for family members) and considers some of the key cases. Provides practical suggestions for solicitors to avoid, detect and deal with conflicts of interest, including the use of information barriers (‘Chinese walls’).

Kerry Hogan-Ross and Robert Crittenden are partners at DLA Phillips Fox. They have specialised in defending negligence claims against professionals for over 20 years and have been LawCover Panel solicitors since 2007.

SESSION THREE

The Mortgage Minefield
Christopher Brierley and Christopher Smith

The obligations on solicitors explaining loan and security documents. How far does the duty go? Are solicitors now required to be detectives to identify the parties? Are solicitors de facto insurers? This presentation will review Rule 45, the new requirements of Section 56C of the Real Property Act and the extent of any expanded duty discussed in the Court of Appeal decision of Riz.

Christopher Brierley is a partner at HWL Ebsworth and has almost 20 years' experience handling LawCover claims. He is the Chairperson of the Law Society of New South Wales’ Commercial Litigation Specialist Accreditation Committee and a member of the Curriculum Advisory Panel for The College of Law’s Master of Applied Law (Commercial Litigation). Christopher Smith is Special Counsel at HWL Ebsworth and has over 12 years' experience handling LawCover claims. They both have extensive experience in defending professional negligence claims against solicitors and are on the LawCover Panel.

Maximising Profitability by Minimising Risk
Ted Dwyer


Challenges the assumption that risk management is separate from increased profitability. Demonstrates that investing in risk management makes good business sense and identifies the common characteristics of law practices with poor risk management procedures. Provides useful, practical ideas and tools that law practices can use to evaluate, as well as improve, practice risk management strategies.

Ted Dwyer is a director of Dwyer Heath. Ted is a risk management specialist, auditing high risk law practices for regulators and insurers. Ted also advises and trains law practices on strategy and commercial management, including pricing, utilisation, profitability, cash flow and matter management.

SESSION FIVE

Understanding and avoiding liability to non-clients
John Coorey and Malcolm Cameron

What are my obligations to an opponent? Do I owe a duty to the other side? Will I be ordered to pay costs? Case studies where solicitors have been the subject of claims by people other than their clients. The cases range from attempts to impose personal costs orders, to substantial claims for damages by parties on the other side of transactions. Identifies the key differences between successful and unsuccessful claims by non-clients, and what those differences tell us about how best to avoid claims of this kind in practice.
